3. About the ARK website

The website provides information about ARK emergency-preparedness products and services for schools and other eligible organisations.

The website is intended to:

  • explain the ARK service and available kit options;

  • provide general emergency-preparedness information;

  • allow schools and organisations to make enquiries;

  • help us assess whether an organisation may be eligible to obtain a particular kit;

  • allow prospective customers to request further information or a quotation; and

  • provide existing customers with relevant support information.

The website is not intended to provide individual medical advice, diagnosis or treatment.

4. Medical and emergency information

Information on this website is provided for general educational and emergency-preparedness purposes only.

It is not a substitute for:

Some ARK kits may contain, or be designed for the storage of, medicines and medical products that are subject to legal and regulatory controls.

Information on this website is provided to explain the ARK service and support emergency preparedness. Nothing on the website constitutes an offer to sell or supply a prescription-only medicine to the general public.

The availability and supply of any kit or product will be subject to:

  • applicable medicines and healthcare legislation;

  • relevant regulatory requirements;

  • the type of organisation making the request;

  • confirmation of eligibility;

  • any required occupational health or governance arrangements;

  • product availability; and

  • any additional checks reasonably required by Arcadia.

 

We may ask an organisation to provide further information or evidence before confirming whether a product can be supplied.

6. Submitting an enquiry or eligibility form

Submitting a form through the website does not:

  • constitute an order;

  • create a contract between you and Arcadia;

  • guarantee that your organisation is eligible;

  • reserve any stock;

  • guarantee a particular price or delivery date; or

  • require Arcadia to accept or fulfil your request.

 

A contract will only be formed when Arcadia has expressly accepted an order in writing or issued another clear written confirmation that a contract has been formed.

An automatic email confirming that we have received your form is an acknowledgement only. It does not mean that an order or application has been accepted.

7. Information you provide

You must ensure that information submitted through the website is accurate, complete and not misleading.

When submitting information on behalf of a school, company or other organisation, you confirm that:

  • you are authorised to make the enquiry;

  • you are authorised to provide the information submitted;

  • the information is accurate to the best of your knowledge; and

  • you will notify us if relevant information changes.

 

You must not knowingly submit false information or misrepresent your organisation’s eligibility, occupational health arrangements or intended use of a product.

Please do not submit detailed medical information about an identifiable pupil, employee or other individual through a general website form unless we have specifically requested that information through an appropriate process.

8. Quotations and orders

Any prices displayed on the website are indicative unless expressly stated otherwise.

The final price, applicable VAT, delivery charges, product specification and delivery arrangements will be confirmed in the relevant quotation, order form or written communication.

A quotation does not oblige Arcadia to supply a product and does not become a binding contract until the order has been accepted in writing.

Unless a quotation states otherwise:

  • quotations are subject to product availability;

  • quotations may be subject to a stated expiry date;

  • delivery dates are estimates until formally confirmed;

  • products remain subject to applicable eligibility and regulatory requirements; and

  • additional delivery or service charges may apply where clearly communicated before an order is accepted.

 

Where separate terms are supplied with a quotation or order, those terms will apply to the relevant transaction. If there is a conflict between these Website Terms and specific written terms relating to an accepted order, the specific order terms will take priority for that transaction.

9. Product information and availability

We take reasonable care to ensure that product descriptions and other information on the website are accurate when published.

However:

  • products, packaging and specifications may be updated;

  • colours may appear differently depending on your screen or device;

  • availability may change;

  • certain products may only be available to specific categories of organisation; and

  • website content may not always reflect an immediate product or regulatory update.
